Your licence

We grant you a personal, non-exclusive, non-transferable licence to install and use Nearhand on Macs you own or control. You are buying a licence to use the software, not the software itself.

If you bought through the Mac App Store, Apple's own terms for licensed applications apply as well, and where they conflict with these terms for that copy of the app, Apple's terms win.

The trial

Nearhand runs with full features for 14 days. No card, no account, no email address. When the trial ends the app stops unlocking paid features; it does not delete anything you put on the shelf, and your files remain exactly where they are on disk.

Buying and refunds

• Direct from this site. Payment and licensing are handled by Lemon Squeezy, who act as merchant of record. Write to us within 30 days of purchase and we will refund it — you do not need to justify the request.
• Through the Mac App Store. Apple handles the purchase and all refunds under their own policy. We cannot issue a refund for an App Store purchase; Apple must do it.

What you may not do

• Share, resell, sublicense or publish your licence key.
• Work around the licensing, or use the app without a valid licence once the trial has ended.
• Reverse-engineer, decompile or disassemble the app, except to the extent that law expressly permits it regardless of this restriction.
• Use Nearhand to capture, record or store material you have no right to, or in a way that breaks the law where you are.

Your files are yours

Anything you put on the shelf — files, recordings, clips, notes — stays yours. We claim no ownership of it and no licence over it. As the privacy policy sets out, we never receive it in the first place.

Keeping your own backups is your responsibility. Nearhand's shelf is a working surface, not a backup system.

No warranty

Nearhand is provided “as is”, without warranty of any kind, express or implied, including the implied warranties of merchantability, fitness for a particular purpose and non-infringement. We do not warrant that the app will be uninterrupted or error-free, or that it will suit any particular purpose of yours.

Some jurisdictions do not allow the exclusion of implied warranties, so parts of this section may not apply to you. Nothing here limits rights you have as a consumer that cannot be limited by agreement.

Limitation of liability

To the fullest extent the law allows, we are not liable for indirect, incidental, special or consequential damages, or for lost profits, lost data or business interruption, arising out of your use of Nearhand — even if we were told such damages were possible.

Where liability cannot be excluded, our total liability is limited to the amount you actually paid for the app.

Updates and changes

We may update Nearhand, and features may be added, changed or removed over time. If we change these terms, the date at the top changes with them. Continuing to use the app after a change means accepting the revised terms.

Ending the licence

You can stop using Nearhand at any time by deleting it. We may end your licence if you materially breach these terms — in practice, if a key is being shared or the licensing is being circumvented. Ending a licence does not touch the files on your Mac.
